Nabarro advises Ryanair on High Court win

Law firm Nabarro has advised Ryanair on a High Court action which resulted yesterday in victory for Ryanair.  Ryanair won an injunction against SR Technics to prevent them attempting to force Ryanair to vacate Hangar 1 at Dublin Airport.

Yesterday’s Judgment by the Honourable Mr Justice Gray was critical of both SR Technics (SRT) and the Dublin Airport Authority (DAA) for their behaviour.  Amongst other findings in his judgment, Mr Justice Gray found that SRT had failed lamentably to comply with its disclosure obligations and that there was collaboration between the DAA and SRT with the proposal that the DAA pay SRT €5million for relinquishing possession of Hangars 1 and 2.  The likely tenant at Hangar 1 was to be Aer Lingus. 

Welcoming today’s High Court Judgment, Chief Executive of Ryanair, Michael O’Leary said:

"I never cease to be amazed by the extent to which the Department of Transport, the DAA monopoly and Aer Lingus are prepared to "collaborate" in their attempts to protect and assist each other, while doing their utmost to disadvantage Ryanair, Ireland's largest and favourite airline."

Peter Fitzpatrick, partner at Nabarro, who acts for Ryanair, comments on the Judgment: "While it is disappointing that Ryanair was forced to pursue this matter through the High Courts, we welcome both the findings and the decision of Mr Justice Gray to require SRT to honour its agreement to use its best endeavours to obtain a 15 year licence for Ryanair to use Hangar 1 at Dublin Airport. We will now work with Ryanair to consider the detailed Judgment of Mr Justice Gray."
